Residential Hours of Operation

Environment Protection Act 1970 & Environment Protection (Residential Noise) Regulations 2008

Unreasonable noise must not emit from construction activities from any residential premises between the following hours:

  • 8.00pm to 7am Monday to Friday;
  • 8.00pm to 9am Weekends and Public Holidays
A Council permit is not available to operate outside prohibited times.

Noise is deemed to be unreasonable if it is emitted from residential premises from construction activity and can be heard in a habitable room in any other residential premises, regardless of whether any door or window giving access to that building is open or not. EPA legislation does not allow for a permit to conduct construction activities and create unreasonable noise from residential premises during the above hours.

Noise from Private Land and Buildings

The following table lists items prescribed in the Environment Protection Residential Noise Regulations and the City of Stonnington General Local Law 2008 (No.1) for specific noise control. Use of these items is prohibited if it causes noise is deemed to be unreasonable:

These Regulations also exempt some types of large scale residential premises under construction from application of the items and times.

Complaints

If you wish to register a complaint about excessive noise, or advise any breaches of noise controls, this can be done in writing or by telephoning Council's Building and Local Law Services Department. Complaints should include the address of the offending property and times at which the alleged offence is occurring.
