Heritage Protection for 29-31 Phoenix Street, South Yarra
Amendment C237 – Interim Heritage Controls
On 25 August 2016 the Minister for Planning approved an interim Heritage Overlay for 29-31 Phoenix Street, South Yarra until 1 June 2017.
The interim Heritage Overlay will ensure the place is protected until Amendment C238 determines whether permanent heritage controls are appropriate.
Amendment C238 – Permanent Heritage Controls
The City of Stonnington has prepared Amendment C238 to the Stonnington Planning Scheme.
Amendment C238 has been prepared to introduce permanent heritage protection to 29-31 Phoenix Street, South Yarra. Specifically the Amendment:
- Varies the Schedule to Clause 43.01 Heritage Overlay to include HO530 29-31 Phoenix Street, South Yarra with permanent heritage status.
- Amend Planning Scheme Map No. 1HO to show HO530, with permanent heritage controls.
Exhibition of the Amendment closed on Monday 15 August 2016.

Council Consideration of Submissions
As a result of exhibition, nine submissions were received. At a meeting on 21 November 2016 Council considered a report (you can view a copy in the Documentation area of this page) on the submissions received. Council resolved to request the Minister for Planning appoint an independent Panel to hear the submissions and consider the proposed Amendment.
The Minister for Planning appointed a one-person Panel to consider the Amendment and submissions received on Amendment C238.
The Panel Hearing was held on 14 February 2017 at Stonnington Council.

The Panel appointed to consider Amendment C238 recommended adopting the Amendment as exhibited, with changes to the citation, as presented at Panel. A copy of the Panel Report and Council’s submission to the Panel can also be found under the Documentation area of this page.
At its meeting on 24 April 2017, Council considered the recommendations of the Panel and resolved to adopt the Amendment with changes. A copy of the Council Report can be found under the Documentation area of this page.
The Amendment has been forwarded to the Minister for Planning for his approval.
