Heritage Protection for 558 Waverley Road, Malvern East
Amendment C247 – Interim Heritage Controls
In October 2016, Council requested that the Minister for Planning prepare and approve an Amendment to apply an interim Heritage Overlay to 558 Waverley Road, Malvern East.
On 2 March 2017 the Minister for Planning approved the interim Heritage Overlay for 558 Waverley Road. It will expire on 17 October 2017.
The interim Heritage Overlay will ensure the place is protected until Amendment C248 determines whether permanent heritage controls are appropriate.
Amendment C248 – Permanent Heritage Controls
The City of Stonnington has prepared Amendment C248 to the Stonnington Planning Scheme.
Amendment C248 has been prepared to introduce permanent heritage protection to 558 Waverley Road, Malvern East. Specifically the Amendment:
- Varies the Schedule to Clause 43.01 Heritage Overlay to include HO531 - 558 Waverley Road, Malvern East with permanent heritage status.
- Amends Planning Scheme Map No. 10HO to show HO531, with permanent heritage controls.
Exhibition of the Amendment closed on Monday 16 January 2017.

Council Consideration of Submissions
As a result of exhibition, one submission was received. At its meeting on 20 March 2017 Council considered a report (you can view a copy in the Documentation area of this page) on the submission received. Council resolved to request the Minister for Planning appoint an independent Panel to hear the submission and consider the proposed Amendment.
The Minister for Planning appointed a one-person Panel to consider the Amendment and submission received on Amendment C248.
The Panel Hearing was held on 16 May 2017 at Stonnington Council.
Council engaged Natica Schmeder of Context Pty Ltd to provide expert evidence. A copy of the Expert Witness Report can be found under the Documentation area of this page.
The Panel appointed to consider Amendment C248 recommended adopting the Amendment as exhibited, with changes to the citation, as presented at Panel. A copy of the Panel Report and Council’s submission to the Panel can also be found under the Documentation area of this page.
At its meeting on 10 July 2017, Council considered the recommendations of the Panel and resolved to adopt the Amendment with changes. A draft copy of the Council Report can be found under the Documentation area of this page.
The Amendment has been forwarded to the Minister for Planning for his approval.
