Consent and Report Forms and Fees
Fee principlesPrior to the operation of the Building Regulations 2006 on 13 June 2006, councils charged the fees they determined necessary for consenting and reporting functions through powers under the Local Government Act. This enabled revenue to meet the costs of service provision to suit local needs.
Sub-regulation 312(2) of the Building Regulations 2006 introduced a limit to the amount a council can charge for considering whether to issue a report and consent to a building permit application, technically regardless of how many matters under Parts 4, 5 or 8 or reg 604(4) of the Regulations are contained in the application.
The Building Commission, however, published advice that the maximum fee is intended to apply per reporting matter rather than per application for a building permit.
Stonnington's Municipal Building Surveyor considers the regulation poorly worded and advises that "the Commission's interpretation directly contradicts the plain reading of the sub-regulation and legal advice I have been given. It is nevertheless Council's decision as to whether it wishes to apply the Building Commission's interpretation of the fee scheme intended or the fee scheme as worded". On 4 September 2006 Council's CEO made the decision that Stonnington would charge a fee per item.
