Road Occupation

Clause 510 of the Local Law reads:

A person must not without a Permit

(a) open, occupy or fence off a Road, or part of a Road: or

(b) erect a structure or temporary crossing for vehicles in or over a Road.

for the purpose of enabling any works to be carried out in, on or over a Road or in or on land adjoining a Road.

Scope

Miscellaneous road occupation can be such things as site sheds, the storage of materials and the running of concrete delivery pipelines, chutes & booms etc over Council land. These all require special permits issued by Council. Please note another category of permit applies to hoardings.

Application Lodgement

Applications for the issue of Local Law permits for road occupation are to be made to Council's Building Local Law Permits & Compliance at the Prahran offices, Cnr Chapel & Greville Streets Prahran by post to PO Box 21 Prahran 3181 or email building@stonnington.vic.gov.au.

Application Requirements

  1. A completed and signed Local Law Permit application form
  2. A copy of a fully dimensioned and detailed site plan.
  3. A pedestrian management plan and/or traffic management plan where pedestrians and/or vehicular traffic are affected.
  4. Evidence of a public liability insurance policy with minimum cover of $10,000,000 and agreement to maintain the cover for the period of the permit.
  5. If any temporary obstruction, occupation or change to the normal footpath or road conditions denies access (as defined in Council's Policy for Road Closures and Obstructions Associated with Building Works), a written submission is to be provided outlining the reasons obstruction is unavoidable.
  6. Applications must generally be lodged at least 2 weeks prior to proposed commencement.
  7. Where an application incorporates closure to traffic in a road or right of way it must be lodged at least 3 weeks prior to proposed commencement to enable Council to carry out notification of properties deemed affected. Alternatively the applicant may, after consultation with Council, provide the consents of properties deemed affected.

Fees

The permit fee is $102.00 (per day) for things such as concrete pours, daily footpath occupation etc.

For the storage of materials the permit fee is $102.00 (one off) and an additional fee of $6.00 per square metre per week up to a maximum charge of $500.00 per week for any Council land occupied.
