Penalty Reminder Notice

If a Parking Infringement Notice is not paid within twenty-eight (28) days of the Service Date, a Penalty Reminder Notice will be sent to the registered owner of the vehicle whose details are provided by the relevant Road Traffic Authority. This process is prescribed in the Infringement Act 2006 and all Victorian Council's and other enforcement agencies are legally required to comply.

At the time of sending the Penalty Reminder Notice, Statutory Court Costs accrue to the original penalty. These costs are set by the Magistrates Court (Fees, Costs and Charges) Regulations 2001 and apply throughout Victoria to all types of fines ie: parking, speeding, red light camera etc.

If the registered owner was not the driver of the vehicle at the time of the offence:
The back of the Penalty Reminder Notice includes a statement form to enable those registered owners, who were not driving the vehicle at the time, to nominate the driver. Legislation requires that the full name and address of the driver must be provided for a nomination to be accepted. If these details cannot be provided, or the nomination fails, 'owner onus' applies and the registered owner of the vehicle will continue to be held responsible for the infringement notice.

It is an offence under the Infringements Act 2006 to intentionally provide false or misleading information on a nomination statement. A fine in excess of $1,000 applies.

Upon acceptance of a driver nomination, responsibility for the infringement notice will be transferred and an infringement notice issued to the nominated driver. The registered owner will receive written confirmation that their nomination has been accepted or rejected.

If you would like to have your infringement heard by a Magistrate in Open Court:
A form titled "Application for Hearing by a Court" is located at the bottom of the reverse side of the Penalty Reminder Notice. It should be noted that only the person named on the Notice is entitled to request this course of action. To request that your case be heard in Open court, complete and return the form to Council. A Summons may then be issued to the applicant and the matter listed for hearing in the Magistrates Court.
