C68 - Stonington mansion site

Deakin University sold the Stonington mansion site (336 Glenferrie Road Malvern) to property developers Hamton and asked Council to rezone the land to Residential 1.  Council exhibited Amendment C68 to the Planning Scheme to rezone the land and to include development controls (Development Plan Overlay) from 28 June to 3 August 2007.

Background

The Stonington mansion site at 336 Glenferrie Road, Malvern is listed on the Victorian Heritage Register and buildings of heritage significance include the mansion, stables and gatehouse.  In December 2006, Deakin University signed a contract of sale agreement with property developers Hamton.  The University ceased operation at the site at the end of 2007. 

As part of the sale, Deakin University requested Council to prepare an Amendment to the Planning Scheme to rezone the land (nearly 3 hectares) to Residential 1.  (The site was zoned Public Use 2 - Education, and the land is in a Heritage Overlay).

As the land is no longer in public ownership the zoning had to be changed to reflect future use.  As part of its considerations of the rezoning, Council believed it essential that issues such as heritage significance, neighbourhood character, residential amenity and traffic management should also be considered.  To ensure this occured, Council introduced additional controls into the Planning Scheme to manage any future development on the site.

Planning Scheme Amendment C68

At its meeting on 21 May 2007 Council resolved to request the Minister for Planning to authorise the preparation of the amendment.  Authorisation was received and the amendment was placed on public exhibition.  Owners and occupiers of the surrounding land were notified and advertisements placed in the Stonnington Leader and the Government Gazette.  

Twenty submissions were received and on 20 August 2007 Council resolved to request the Minister to appoint an Independent Panel to consider the submissions. 

Panel Hearing

The Panel Hearing was held in the Council Chamber - Stonnington City Centre (Malvern Town Hall) from 9th - 11 October 2007. 

The C68 Panel Report was received by Council on 19 November 2007.

At its meeting on  3 December 2007 (view report, attachments and minutes) Council considered the Panel report and decided to adopt Amendment C68 and submit the amendment to the Minister for Planning for approval.

On 3 January 2008 Amendment C68 was approved by the Minister for Planning.

Development Proposal

Hamton submitted an application for a Planning Permit to Heritage Victoria (Application No. P11884).   For information on this application call Andrew Leoncelli, Hamton Development Manager on 9522 8423 or go to the Heritge Victoria Website to view a copy of the permit approved on 18 December 2007.

SJB Planning (on behalf of Hamton) has lodged an application for a Planning Permit (Application No. 771/07) with Council. 

It should be noted that both of the applications to Council and to Heritage Victoria are for identical development, however approval must be sought from both organisations under the Planning Scheme requirements.

At its meeting on 4 February 2008 Council considered the proposed Planning Permit 771/07.  The application was subsequently referred for further consideration at Council's meeting to be held on 18 February 2008.  Go to Council's website to view the Notice paper/Agenda for this meeting.
