Response to Victorian Ombudsman report on City of Stonnington parking

City of Stonnington Council has resolved to reconsider parking infringement appeals in Stonnington that were lodged between 1 July 2006 and 9 February 2017.

Please note that this only applies to individuals who appealed a parking infringement unsuccessfully between 1 July 2006 and 9 February 2017 and subsequently made payment to the City of Stonnington and not every person who received and paid a parking infringement.

Background information

Prior to 2017, Council asked Tenix (Council’s third party parking contractor) to provide a recommendation in relation to parking infringement reviews prior to a Council officer making a decision on each review request.

In 2017, Council removed Tenix from providing recommendations and conducted the entire internal review of parking infringements itself.

Council amended its process to ensure that there was no risk of non-compliance with the laws in place regarding the contracting of third parties for assistance with internal reviews.

Who does this apply to?

This applies to individuals who appealed a parking infringement unsuccessfully between 1 July 2006 and 9 February 2017 and subsequently made payment to the City of Stonnington.

It does not apply to every person who received and paid a parking infringement.

Why do I need to request a refund?

When a request for refund is received, Council will investigate whether or not your initial parking infringement appeal was decided by an authorised Council officer exercising their discretion in making the decision. If we find that it wasn’t, a refund will be provided.

Will I need proof of my appeal?

Council will re-assess all requests for review and make a decision and respond by written letter.

The review process can take up to 90 days.
