Building works outside of regular hours

We are currently experiencing an unusually high volume of permit requests. There may be a delay in the response to your call or permit request.

Building activity works can impact the neighbourhood's amenity through noise emissions and other disruptions.

Local law allows building activity during these hours:

  • Monday to Friday, 7 am to 6 pm
  • Saturday, 9 am to 6 pm

You need an out-of-hours permit to conduct building works outside of these hours and on Sundays or public holidays.

We only issue out-of-hours permits for specific safety purposes, not routine building activities.

Building activity that requires a permit

Building activity that requires a permit includes the following over or across any road or Council land:

  • construction, repair or demolition
  • removal or erection of scaffolding
  • excavation and removal of soil, clay, rock or other materials
  • moving waste, building equipment, building materials or rubble, or second-hand building materials
  • any work or action incidental to the above.

If works are on a designated VicRoads road, you need to apply for a Memorandum of Authorisation (MoA) from VicRoads before applying to us. You must include the MOA in your application.

You may also need a Road Occupation Permit if your works impact roads.

How to apply

Prepare your documents

You need to provide the following with your application:

  • Detailed, fully scaled site plan showing the size and layout of the work area
  • Relevant additional permits such as Road Occupation (required for any works that occupy Council-managed roads or road-related areas, including footpath and nature strip)
  • Traffic management plan outlining safety measures for road or footpath occupation
  • VicRoads Memorandum of Authorisation (MoA) (if works are on or will affect the entry in and out of a designated VicRoads road)
  • Proof of public liability insurance with a minimum coverage of $20 million
  • Applicable fee.

Log in to the portal to apply for building works outside of regular hours. If you don't have an account, you can sign up. Find out more about our online services.

Once logged in:

  • select ‘All applications and permits’ under Apply for something
  • find ‘Construction permits’ and select Start
  • in the drop-down, select 'Building works outside of regular hours'
  • follow the prompts.
