Building works create noise that can change the amenity of neighbouring premises. Local law allows building activity during these hours:
- Monday to Friday, 7 am to 6 pm
- Saturday, 9 am to 6 pm
You need an out-of-hours permit to conduct building works outside of these hours and on Sundays or public holidays.
We only issue out-of-hours permits for specific safety purposes, not routine building activities.
Building activity that requires a permit
Building activity that requires a permit includes the following over or across any road or Council land:
- construction, repair or demolition
- removal or erection of scaffolding
- excavation and removal of soil, clay, rock or other materials
- moving waste, building equipment, building materials or rubble, or second-hand building materials
- any work or action incidental to the above.

Please note this permit does not override the Environment Protection Act 1970 requirements or the Environment Protection (Residential Noise) Regulations 2008.
How to apply
You will need to login to the portal to apply. If you don’t have an account, you can sign up.
You need to provide the following with your application:
- Detailed, fully scaled site plan showing the size and layout of the work area
- Relevant additional permits such as Road Occupation (concrete pumps or crane)
- Traffic management plan outlining safety measures for road or footpath occupation
- VicRoads Memorandum of Authorisation (MoA) (if works are on a designated VicRoads road)
- Proof of public liability insurance with a minimum coverage of $20 million
- Applicable fee.
